INTERNATIONAL  LIMITED WARRANTY

WITH LOVUM WRITTEN APPROVAL AND AUTHORIZED VENDOR INSTALLATION & SERVICE

Lovum Doors LLC provides a Limited Lifetime Warranty, to the original owner/end user of the structure in which the product is installed and is not transferable. This warranty begins on the date the door, and/or screen is completed in the factory.  Lovum Doors LLC warrants in accordance with the conditions, limitations, and restrictions outlined below that every Lovum door product shall be free of defects in workmanship, and materials that would cause the product to be unfit to perform. This guarantee ensures that the product will remain serviceable for standard daily use, for the time stated in the table below. This Warranty is given with the utmost professionalism and dedication to quality, to ensure compliance, it is necessary to register the door(s) within 6 months of installation and to follow the care and maintenance recommendations.

* Coastal: Within 1 mile of the coastline.

As per the times stated in the above table:

1. EXTRUDED ALUMINUM AND PULTRUM FRAME COMPONENTS are protected against manufacturing flaws that could lead to compromised structural integrity.
2. PROFOLD OPERATIONAL HARDWARE (hinges, guides, and rollers) is warranted to be free from defects in workmanship, and materials that would cause the product to be unfit to slide, open, and close. 
3. LOCKING MECHANISM AND HANDLES are warranted from quality and defects that may prevent the operation of the doors.
4. PAINT FINISHES are warranted from cracking peeling, blistering, peeling, or fading.
5. GLASS, Standard insulated glass units with super-spacer bar are warranted against seal failure due to manufacturing defects resulting in visible obstruction through the glass (lines, discoloration, or surface Flaws) from 10 ft. looking through the glass, as per the ASTM C1036-01 Federal guidelines. Laminated glass is warranted from de-lamination resulting in visible obstruction through the glass. Other types of glass are provided with the same warranties, limitations, and exclusions received from the supplier.
6. SMART LOCK AND COMPONENTS warrants that theproduct will be free from manufacturing defects in technical and material resulting in failure to operate.
7. SCREEN, SCREEN/BLIND COMBINATION is warranted for interior applications only, pleated, and solid fabrics are not designed to prevent accidents or withstand windy conditions.

COASTAL CARE AND MAINTENANCE RECOMMENDATIONS

To ensure the longevity of your product and maintain its warranty, it is essential to regularly clean and lubricate all operational hardware, including handles, glass, and surfaces. This will prevent salt corrosion, residue buildup, and finish discoloration, keep tracks free from debris, and regularly apply lubricant to ensure hardware slides freely. Follow the guidelines outlined in the Owner's Manual using the recommended cleaning products.

COASTAL APPLICATIONS CARE AND MAINTENANCE RECOMMENDATIONS

It is important to keep in mind that for products installed within a mile or near the coastline will require more cleaning. Besides the care and maintenance recommendations in the owner’s manual, to keep your products in good condition, it is highly recommended that you clean the handles, and frame once a month using a mild soap solution and a soft rag. After cleaning, make sure to rinse with water to remove any soap residue. Glass areas can be cleaned as needed with a commercial glass cleaner. Additionally, make sure to clear any debris from the tracks and apply silicone spray to the bottom guides every three months. It is important to take measures to prevent salt damage at an early stage.

COMMERCIAL APPLICATIONS CARE AND MAINTENANCE RECOMMENDATIONS

For doors installed in commercial spaces, it's important to train your staff to handle the doors and prevent customers from using them to avoid harm or misuse. In the hospitality industry, it's advisable to provide printed instructions for guests to operate the doors and have a staff member demonstrate the process. Additionally, keep in mind that doors in busy areas tend to collect debris and trash, so it's essential to clean the bottom track daily to ensure the guides slide smoothly.  For coastal commercial applications cleaning of the surfaces should be as frequent as needed. Bottom tracks should be cleaned of debris daily.

**If the buyer or end-user fails to adhere to the installation, care, and maintenance instructions, or uses the product inappropriately; all explicit warranties stated in this limited lifetime warranty will become null and void.

EXCLUSIVE REMEDY

Lovum Doors LLC warranty begins from the date of order completion and is not a warranty of future performance. If any such a failure occurs during the period of your warranty, and in accordance with its terms stated above. Lovum Doors LLC will, in its sole discretion, repair, or replace the product or component, and ship at your cost, or refund the price for the defective product or component. The warranty on the replacement parts will extend only for the balance of the warranty period of the original product. In no event shall Lovum Doors LLC. be responsible for the cost of labor to replace the parts or any costs associated with the removal, installation, sales tax, shipping outside of the country, finishing, refinishing, or any other associated incidental or consequential cost, for the replacement of components or parts, unless expressly required by state law. 

EXCLUSIONS

The warranty provided has certain limitations and does not extend to situations that do not signify a defect in the product or arise due to factors beyond the control of Lovum Doors LLC, which includes but is not limited to:

• Any products that Lovum Doors has not received complete payment.
• Product installed and used in applications exceeding design standards.
• Acts of nature (hurricanes, tornados) unusual or extreme atmospheric situations, war, insurrection, terrorism.
• Negligence, product abuse, misuse, modifications, alterations, accidents.
• Failure to report damages upon delivery, or present proof before installation.
• Failure to report issues within 30 days of identifying a problem.
• Slight bowing under 1/4” in aluminum panels when exposed directly to the sun is not to be considered a defect .
• Damages to finish, glass, hardware, or weather seals caused during or after installation.
• Damage to components, hardware, cables, and/or to electronic elements not reported prior to installation, arising from negligence during the installation process.
• Failure to follow Lovum Doors installation instructions and relevant building codes.
• Non-factory cutting, resizing, or altering any of the system’s hardware or components.
• Installation in a slope or non-square application will void all warranties.
• Improper or non-standard field finishing.
• Non-factory: modifications, electronic devices, and/or third-party sensors.
• Failures caused by structural settlement, shifting where the product is installed.
• Improper screen assembly, installation, and poor maintenance.
• Screen damage cause by accidental fall, or run through by people, pets or wild animals, misuse, abuse, cloth fading from sun exposure.
• Screen installed on the exterior of an opening are not covered by this warranty.
• Failure by corrosion, vibration, localized heat exceeding 150 degrees, harmful fumes, vapors, or chemicals.
• Failure to report glass cracks, surface damages, and breakage, when the product is been unpacked and before installation.
• According to the ASTM C1036-01 Federal guidelines, any flaw in the glass (lines, discoloration, or surface Flaws) that does not affect the structural integrity, obstruct vision, or cannot be detected from 10 feet while looking through the glass is considered acceptable.
• Failure resulting from installation in high moisture areas or sources of chlorine, in areas that fail to provide proper drainage, ventilation, and moisture management. Condensation on the interior of the product from exposure to excess humidity.
• Failure to order capillary tubes for high altitude applications or failure to properly close them when not installed in high altitude.
• Glass unit failure due to the application of aftermarket films, tints, or other non-factory modifications.
• Glass replacement or modification not performed by Lovum Doors Authorized Vendor.
• Glass unit damage for any reason, cracked, shattered, broken, for any cause, or seal failure because of contact with chemicals.
• Glass imperfections allowable with ASTM or industry standards, not affecting structural integrity.
• Glass damage caused by using razor blades, inappropriate cleaners, or chemicals.
• Lovum does not guarantee the quantity or ratio of argon/other inactive gas presence in the unit, nor do we assure that the effectiveness of the gas will remain consistent over time.
• Finish fading, cracking, blisters, or damage unnoticeable from a distance of 10 feet.
• Failure due to power surges, and battery corrosion from high humidity exposure.
• Failure to follow Lovum Doors care and maintenance guidelines will void this limited warranty.
• Normal wear and tear, discoloration, or fading of finishes from daily sun exposure.
• Product installed without proper drainage or moisture management.
• Condensation, frost, mold mildew, or fungus on product surfaces. (This is not a product defect. Is the result of excess humidity from poor management of water and moisture infiltration in the construction).
• Corrosion of hardware due to environmental conditions and poor maintenance.
• Improper operation of the panels, including failure to allow the electric mechanism to complete its full cycle.
• Extreme use or abuse of operational hardware resulted from negligence to instruct guests how to operate the door.
• Water intrusion, air infiltration, or conditions as a result of factors, flaws, or deficiencies not relevant to the product itself caused by construction, design, negligence, or poor judgment.
• Water intrusion on flush applications without proper drainage, slope away from the door, and/or 10 ft. minimum overhead
• The product that has been sold by a third party or unauthorized vendor in/or outside the United States.
• Products that are supplied to us by client request (including but not limited to custom hardware smart devices) made by a third party. 
• Damages caused by shipping, handling, or relocating of the product by a third-party
• Corrosion, finish failure, and tarnish hardware in coastal applications caused by acid rain, salt, air pollutants, sand, or chemical substances.
• Replacement of parts, hardware, screen mesh or blind, glass, and other products of the doors and screens not supplied by Lovum Doors, LLC.

DISCLAIMERS AND LIMITATIONS

Disclaimer

Lovum Doors LLC provides only one warranty, which is this limited warranty, whether it is written or spoken, explicit or implicit. No third party, Authorized Vendor, employee, or agent of Lovum Doors is authorized to create or be held liable or responsible for any other obligation or liability on behalf of Lovum. The warranty does not cover any implied warranties, including but not limited to, warranties of fitness for a particular purpose, merchantability, durability, climate, condition, or suitability for a particular design or project. This warranty does not guarantee future performance or the useful life of any Lovum product but only ensures repair, replacement, or refund.

If state law prohibits the exclusion or limitation of implied warranties, the process for making a claim will be the same as that outlined in the express warranty stated herein. Any products or components not covered by this limited warranty, or another express limited warranty provided by Lovum Doors are sold without any warranty and "as is." If the end user, Authorized Vendor, architect, licensed installer, owner, or construction professional fails to adhere to the installation and maintenance instructions provided (available online in PDF and instructional videos) all express warranties will be null and void. It is crucial to follow the instructions provided to ensure warranty coverage.

Limitations

Lovum Doors LLC cannot be held responsible for any incidental, special, consequential, indirect, contingent, or punitive damages arising from claims related to breach of warranty, breach of contract, tort, strict liability, or any other cause. This includes claims related to the delivery of defective or non-conforming goods, breaches of any other provisions of this limited express warranty, or disputes arising from contracts between Lovum Doors Registered Authorized Vendors and their customers, agents, employees, subcontractors, end-users, or other third-party entities involved in recommendation, installation, modification, or repair. In no case, will Lovum Doors LLC liability exceed the purchase price of the product or component in question. No Authorized Vendor, employee, or representative of Lovum Doors can change, or in any way modify either orally or in writing this Limited Warranty, any changes made will not hold legal power or influence.

Certifications and Ratings

Certification and ratings are usually based on testing a single product sample through a range of computer simulations and physical tests that are conducted by a California state-approved testing facility. However, it is important to note that the performance of individual products may differ due to varying usage conditions and installation locations. It should also be clarified that these certifications and ratings should not be perceived as performance warranties.

Suitability

In no circumstance is Lovum Doors LLC liable for determining the suitability of any product for a specific project, design, application, climate, condition, customer need, use, or purpose. Additionally, Lovum Doors cannot guarantee that the integration of its products into a building design will obtain any third-party certification or standards. Doors and windows are merely one component of the building envelope. Lovum Doors will not be held liable for any claims of damage arising from inappropriate product selection, faulty building design or construction, damage to the building, improper installation, or inaccurate orders. Selection of application, glazing materials, sealant, and product configuration is out of our control, therefore Lovum Doors assumes no responsibility. The responsibility of determining product suitability, glazing materials, applications, and configurations lies with the Authorized Vendor, owner, user, architect, licensed installer, and/or construction professionals to follow applicable laws and codes to make selections and stay in compliance. Even if the exclusive remedy mentioned in this limited warranty is deemed to fail for its essential purpose, these limitations of warranty and liability shall apply and survive.

Governing Law, No Class action, No Jury Trial

THE WARRANTY WILL BE GOVERNED BY THE LAWS OF CALIFORNIA, AND ANY DISPUTES OR CLAIMS AGAINST LOVUM DOOR SYSTEMS, IT’S EMPLOYEEES, AUTHORIZED VENDORS OR AFILIATES MUST BE MADE ON AN INDIVIDUAL BASIS AND NOT AS A REPRESENTATIVE OF ANY GROUP OR IN ANY OTHER REPRESENTATIVE LEGAL ACTION, OR MEMBER OF ANY CLASS ACTION OR PROCEEDING, UNLESS SUCHA A WAIVER IS PROHIBITED BY LAW.

ANY CLAIM OR DISPUTE SHALL FIRST BE DETERMINED BY MUTUALLY AGREEABLE TERMS, ANY DISPUTE WITH LOVUM DOORS WILL NOT BE DETERMINED BY JURY TRIAL, THEY KNOWINGLY WAIVE THE RIGHT TO A JURY TRIAL. THEY ELECT TO SUBMIT ALL DISPUTES UNDER THIS WARRANTY TO A MUTUALLY AGREEABLE MEDIATOR, WITH EACH SIDE TO BEAR ITS OWN FEES AND COSTS. IF THE DISPUTE IS NOT RESOLVED THE DISPUTE SHOULD BE SUBMITTED TO A MUTUALLY AGREEABLE ARBITRATOR, PURSUANT TO THE ARBITRATION RULES OF THE STATE OF CALIFORNIA. IN THE EVENT OF ANY CLAIM MADE UNDER THIS WARRANTY, THE WINNING PARTY SHALL BE ENTITLED TO RECEIVE REASONABLE FEES FOR ATTORNEYS, EXPERTS AND COSTS. IN CASE A CLAIM IS RELATED TO THE INSTALLATION OF THE PRODUCT, LOVUM DOORS RESERVES THE RIGHT TO COLLECT ATTORNEY FEES, EXPERT FEES AND PRODUCT TESTING EXPENSES. THIS IS A STANDARD PRACTICE IN THE INDUSTRY AND, IS AIMED AT ENSURING FAIRNESS AND TRANSPARENCY FOR ALL PARTIES INVOLVED. 

No Waiver

If Lovum Doors LLC decides to deviate from any of the conditions or limitations stated in this limited warranty, it will only apply to a specific circumstance and for a limited time, as determined solely by Lovum Door Systems. This exception should not be interpreted as a waiver of Lovum Doors LLC's right to enforce all conditions and limitations stated in the warranty.

Conditions and Procedures

As outlined in the Terms and conditions of your purchase, it’s crucial to inspect your product immediately upon delivery. Any damages to the packages   should be reported directly to the driver, it is advisable to document evidence with notes, images and/or videos. Ensure that all images and video evidence is taken with the product, in the crate, or in the cardboard wrapping, before installation. For any warranty claims, report them as soon as they are identified, ideally no later than 60 days after discovery and within the warranty period, before any repairs are undertaken

If you encounter any issues with your Lovum Door, your first step should be to contact the Authorized Vendor from whom you purchased the product. You can find their information, along with details about your product and installer, in your Owner’s Manual.  If you cannot retrieve the Vendor’s information or if they are unresponsive, please fill out a technical assistance request. We can assist locating your Vendor or put you in touch with a nearbyAuthorized Vendor that can assist.

All claims must be made in writing. Please include the following information:

• Your name, address, and telephone number
• Door ID# located on the Main door. Behind thecover with the Lovum Door metal plate.
• Proof of purchase from Authorized Vendor, if purchased directly.
• Installer name or company if known.
• Date the issue was identified.
• Explain the issue (include relevant photographs or video).
• Include pictures and/or video relevant to the issue.

We will confirm receipt your inquiry and contact you within 24 hrs. Our team will reach out to the Authorized Vendor on your behalf. If necessary, we’ll coordinate a virtual call with the installer on-site to help resolve the issue efficiently. This method has proven effective in pinpointing possible causes and solutions for installers to address. Should the issue fall under warranty, we’ll arrange for a technician to complete the required warranty covered repairs as soon as the necessary parts and components are ready.
